A Beginner’s Guide To Litigation

Civil litigation is the term used for a legal dispute that has occurred involving two or more opposing parties to enforce or defend a legal right. Often seeking money damages or a specific performance.

Civil Litigation is the act of bringing in a lawsuit to resolve any disputes before a court. This article focuses on civil litigation from the point of view of yourself as the business owner or individual who has decided to take someone to court or who has been taken to court.

There are always two parties to a law-suite — the plaintiff, who files the lawsuit, and the defendant, the person the lawsuit is against.

An extensive amount of conflicts can be encompassed into civil litigation.  Lawyers will usually specialize in a couple of the specific areas.

What are the three components of the process of resolving a dispute or disagreement?

Dispute resolution processes fall into two major types:

  • Adjudicative processes, such as litigation or arbitration, in which a judge, jury or arbitrator determines the outcome.
  • Consensual processes, such as collaborative law, mediation, conciliation, or negotiation, in which the parties attempt to reach agreement.

Our lawyer Sabrina’s considerable expertise in Alternative Dispute Resolution (ADR) and Mediation and her willingness to utilise these methods to resolve disputes to your satisfaction. Nevertheless where commercially appropriate, she have no hesitation in resorting to litigation to achieve your objectives.

Contractor Disputes

A contract is a legally binding document that a minimum of two parties sign in order to make an agreement. There are many different types of contract with common ones including contracts of employment and commercial contracts.

If one party fails in its obligation it results in a breach of contract and may give rise to bring a claim for compensation depending on the impact on the other parties.

Contracts should not be entered into without taking into account the implications that a breach of the agreement may bring, it should always be remembered that contracts are designed to be binding.

Alternative Dispute Resolution

Alternative Dispute Resolution (ADR) is a mechanism whereby a case is formally resolved or adjudicated outside of court. ADR can be contractual (all parties sign a contract agreeing to use ADR in lieu of a traditional lawsuit) or court-ordered.

We are keen to resolve disputes in the most practical and cost effective way for clients. . Even where Court proceedings have been issued, it may still be possible to utilise ADR to bring a swift conclusion to the proceedings, if the parties are willing to participate.

There are three main types of alternative dispute resolution: binding arbitration, mediation/facilitation and case evaluation.
We will consider ADR with you when we first discuss your case, when we will provide further information concerning the process and consider whether it is a viable option for you.

Mortgage Litigation & Enforcement

Has this happened to you?

  • You fell behind on mortgage payments and your lender is giving you misleading information about your options to save your home
  • You have applied for a loan modification and your lender is sending you foreclosure notices at the same time
  • Your lender lied to you about stopping foreclosure while you were being reviewed for a modification.

Many homeowners find themselves in the foreclosure process, whether they just received a Notice of Default from their lender or just received a Notice of Sale with an auction date scheduled in the next couple of weeks. These homeowners’ main concern is how to stop a foreclosure.

Call us if you want to:

  • Save your home from foreclosure
  • Stop the foreclosure process while you are in review for a modification
  • Discuss other options for saving the home or enter into a payment plan to catch up

As your mortgage fraud attorney, we evaluate the original terms of the promissory note, the efficacy of the modification process, and the actions taken by the lender in servicing the loan. We often find that foreclosure fraud occurs when lenders violate the law by creating unconscionable loan terms.

Mortgage litigation empowers the homeowner to take the lender to court. The homeowner can no longer be ignored or strung along until the lender decides to foreclose. We provide litigation support giving homeowners their day in court and the chance to resolve their disputes and negotiate on an equal level with their lender.
