As mentioned earlier there are 3 documents you can prepare that may be helpful to friends, family and health care providers. They include:
1. A Will
2. A Continuing Power of Attorney for Property
3. A Power of Attorney for Personal Care
1. A person’s will is a written document that sets out the person’s wishes about how his or her estate should be taken care of and distributed after death. It takes effect when the person dies.
2. A Continuing Power of Attorney for Property is a legal document in which a person gives someone else the authority to make decisions about their finances. The person who is named as the attorney does not have to be a lawyer.
The power of attorney is called “continuing” because it can be used after the person who gave it is no longer mentally capable to make the financial decisions themselves. Some people use the word “durable” which means the same as “continuing”.
If you become mentally incapable, who will decide where you will live? How you will dress? What you will eat? What health care you will receive? How your safety will be assured? Under the Substitute Decisions Act, 1992, the person you choose as your attorney for personal care will make these decisions for you.
3. A Power of Attorney for Personal Care is a legal document in which one person gives another person the authority to make personal care decisions on their behalf if they become mentally incapable. Some people use the word “Living Will” which is for Ontarions is POA for Personal Care

The forms for a Continuing Power of Attorney for Property and a Power of Attorney for Personal Care contained herewith were revised on March 29, 1996 in accordance with amendments to the Substitute Decisions Act, 1992.
Remember, POA for Personal Care does NOT allow decisions to be made about your property or finances. If you want to appoint an attorney for your financial decisions you should make a separate document for “Continuing Power of Attorney for Property. (and Visa Visa)

A Power of Attorney for Personal Care (POAPC) covers your personal decisions, such as housing and health care.
Is a lawyer needed to complete a Will or Power of Attorney?
Completing a legal Will and /or Power of Attorney is a serious endeavor.
According to current laws in certain provinces, in order to be a legal document your Power of Attorney must be signed in the presence of two witnesses, and in front of a Notary Public. A Notary Public /Lawyer has the legal standing to administer oaths and officiate over the signing process.
In Onatario the law does not require you to use a lawyer’s services. However, it is ADVISABLE to have a lawyer review the documents to ensure they are executed properly. As well, if a notarized copy is produced, it reduces the risk of potential fraud as the notary is required to compare the original Power of Attorney to the copy prior to notarizing the copy.
It is advisiable to have a Notorized Power of Attorney for Property, since in Canada most of the banks and financial institutes will not accept an un-notrized POA
